Welcome to Diaspora Link. These Terms of Service ("Terms") govern your access to and use of the Diaspora Link mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the Service, you:

• Agree to be bound by these Terms and our Privacy Policy
• Represent that you are at least 18 years of age
• Represent that you have the legal capacity to enter into these Terms
• Agree to comply with all applicable laws and regulations

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Diaspora Link is a platform designed to connect diaspora communities worldwide. The Service includes:

• Job posting and application services
• Housing listing and search features
• Ride sharing coordination
• Community forums and discussions
• Direct messaging and group chats
• User profiles and networking
• Notifications and alerts

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Restrictions

You may not:

• Create multiple accounts for fraudulent purposes
• Share your account with others
• Use another user's account without permission
• Create an account if you have been previously banned
• Use automated tools to create accounts

4. Acceptable Use Policy

4.1 Permitted Uses

The Service is intended for legitimate personal and professional networking within diaspora communities. You may use the Service to:

• Search and apply for employment opportunities
• Post legitimate job openings
• Search for or list housing accommodations
• Coordinate ride sharing arrangements
• Connect and communicate with community members
• Share relevant community information and resources

4.2 Prohibited Conduct

You agree NOT to:

• Post false, misleading, or fraudulent content
• Harass, abuse, threaten, or intimidate other users
• Post discriminatory content based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Share illegal content or engage in illegal activities
• Post spam, advertisements, or unsolicited marketing
• Impersonate others or misrepresent your identity
• Violate intellectual property rights
• Post sexually explicit or offensive content
• Attempt to hack, disrupt, or compromise the Service
• Scrape, crawl, or collect user data without permission
• Use the Service for any unlawful purpose

5. User Content

5.1 Your Content

You retain ownership of all content you post on the Service ("User Content"), including job postings, housing listings, messages, photos, and other materials. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content to provide and improve the Service.

5.2 Content Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:

• You own or have the necessary rights to post your User Content
• Your User Content does not violate these Terms or any laws
• Your User Content does not infringe third-party rights
• Your User Content is accurate and not misleading

5.3 Content Moderation

We reserve the right (but not the obligation) to:

• Review, monitor, and moderate User Content
• Remove or edit User Content that violates these Terms
• Take action against users who violate these Terms
• Cooperate with law enforcement when necessary

6. Jobs and Employment Services

6.1 Job Postings

If you post job listings, you warrant that:

• The job posting is legitimate and accurate
• You have authority to hire for the position
• The posting complies with employment laws
• You will not discriminate based on protected characteristics

6.2 No Employment Relationship

Diaspora Link is a platform only. We are not a party to any employment relationship between employers and job seekers. We do not guarantee job placements or employment outcomes.

7. Housing Listing Services

7.1 Housing Listings

If you post housing listings, you warrant that:

• You have legal authority to list the property
• The listing information is accurate and complete
• The property meets applicable safety and legal requirements
• You comply with fair housing laws

7.2 No Landlord-Tenant Relationship

We are not a party to any rental agreements. All terms, conditions, and payments are between the landlord and tenant.

8. Ride Sharing Services

8.1 Ride Coordination

The Service facilitates ride sharing coordination. We are not a transportation provider or ride-hailing service. All ride sharing arrangements are made directly between users.

8.2 Safety and Liability

We do not verify driver credentials or vehicle safety. You participate in ride sharing at your own risk. We are not liable for accidents, injuries, or damages arising from ride sharing arrangements.

9. Messaging and Communications

The Service includes messaging features with end-to-end encryption. You agree to:

• Use messaging for legitimate communication
• Respect other users' privacy and communication preferences
• Not send spam, harassment, or unsolicited messages
• Report abusive or inappropriate messages

10. Payments and Fees

10.1 Free Service

Diaspora Link is currently free to use. We reserve the right to introduce fees for certain features in the future with advance notice.

10.2 Third-Party Payments

Any payments between users (e.g., rent, ride sharing fees) are handled directly between parties. We are not involved in these transactions and are not responsible for payment disputes.

11. Intellectual Property Rights

The Service, including its design, features, code, graphics, logos, and trademarks, is owned by Diaspora Link and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary materials
• Reverse engineer or decompile the application
• Use our trademarks without permission
• Create derivative works based on the Service

12. Disclaimers and Warranties

We disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service
• Security of data transmission
• Verification of user identities or credentials

13. Limitation of Liability

Our total liability for all claims shall not exceed $100.

14. Indemnification

You agree to indemnify, defend, and hold harmless Diaspora Link, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your interactions with other users
• Your violation of any laws or third-party rights

15. Dispute Resolution

15.1 Informal Resolution

If you have a dispute with us, please contact legal@diaspora-link.com first. We will attempt to resolve disputes informally within 30 days.

15.2 Arbitration Agreement

If informal resolution fails, disputes shall be resolved through binding arbitration. You waive your right to a jury trial and class action lawsuits.

16. Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent or illegal activities.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or app notification. Continued use after changes constitutes acceptance.
